<h3>The Universal Declaration of Human Rights</h3>
<p>Before we get to the Convention on the Rights of Persons with Disabilities (CRPD, also known as UNCRPD), let's review the<strong> Universal Declaration of Human Rights</strong> (UDHR).</p>
<p>The Universal Declaration of Human Rights (UDHR) is a milestone document in the history of human rights. Drafted by representatives with different legal and cultural backgrounds from all regions of the world, the Declaration was proclaimed by the United Nations General Assembly in Paris on 10 December 1948 (General Assembly resolution 217 A) as a common standard of achievements for all peoples and all nations.</p>
<p> It sets out, for the first time, fundamental human rights to be universally protected and it has been translated into over 500 languages. The UDHR is widely recognized as having inspired, and paved the way for, the adoption of more than seventy human rights treaties, applied today on a permanent basis at global and regional levels (all containing references to it in their preambles).</p>
<p>A grounding in human rights helps promote a fuller understanding of the core principles and concepts underlining disability rights.</p>
<p><strong>After all, disability rights are human rights.</strong></p>
<ul>
<li><strong>Universal</strong> in that human rights apply equally and without discrimination to every single human being on the planet;</li>
<li><strong>Inherent</strong> in that human rights are natural to who you are as a human being; and,</li>
<li><strong>Inalienable </strong>in that human rights automatically belong to every single human being with these rights independent of a government's whim or action.</li>
</ul>
<p>So, what does a rights-based approach to disability rests on?</p>
<p>Michael Schwartz will explain it next.</p>

<p>A rights-based approach to disability rests on four pillars:</p>

<li>Empowerment: persons with disabilities must make their own choices, advocate for themselves, and exercise control over their lives.</li>
<li>Enforceability and remedies: persons with disabilities must be able to enforce their human rights at the national and international levels.</li>
<li>Indivisibility: Multiple rights of persons with disabilities are indivisible: civil, political, economic, social, and cultural rights all are to be protected.</li>
<li>Participation: This is the principle of "Nothing About Us Without Us." Persons with disabilities must be consulted and make their own decisions as they control their lives.</li>
</ul>
<p>It is important to remember one thing: disability rights are human rights!</p>

<h3>Human Rights Instruments</h3>
<p>Human rights are outlined in a variety of international human rights documents sometimes called instruments.</p>
<p>These instruments provide us with an overall human rights framework.</p>
<p>The Universal Declaration of Human Rights, a treaty, and the two covenants, the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights, are a package understood as the International Bill of Rights.</p>
<p>The core concept behind the UDHR is the idea expressed in the first Article 1 that states:</p>
<blockquote>
<p> "All human beings are born free and equal in dignity and rights."</p>
</blockquote>
<p><strong>Did you know?</strong></p>
<p>The original language was "All men are born free and equal". Hansa Mehta of India, a woman, has been widely credited for changing the opening from "all men" to "all human beings."</p>
<p>Human rights under the UDHR are indivisible, interdependent, and interrelated.</p>
<p>For example, a person's ability to vote can be affected by the absence of enforcement of the rights to education (Article 26), freedom of opinion and information (Article 19), or even an adequate standard of living (Article 25). </p>

<h3>Respecting, protecting, and fulfilling human rights</h3>
<p>Three fundamental obligations of States Parties* are best summed up in an acronym: RPF. The obligations to respect, protect, and fulfil human rights inspires the text of the CRPD:</p>
<ol>
<li><strong>Respect</strong>: Refrain from interfering with the exercise and enjoyment of the rights of persons with disabilities. Eliminate laws, policies, and practices that contravene human rights.</li>
<li><strong>Protect</strong>: Prevent abuses of persons with disabilities by non-State actors such as individuals, businesses, institutions, or other private organizations.</li>
<li><strong>Fulfill</strong>: Take positive action to enable human rights for all, including persons with disabilities. Adopt laws and policies promoting human rights. Develop programs to support the exercise and enjoyment of human rights for all, including persons with disabilities. Allocate necessary resources to enforce human rights.</li>
</ol>
<p>*<em>States Parties are countries that have ratified or acceded to the international Treaty. Through ratification or accession, a country agrees to be legally bound by the Treaty's provisions.</em></p>

<h3>Responsibility for Human Rights</h3>
<p>Responsibility for human rights is a shared one:</p>
<ul>
<li><strong>Governments: </strong>States Parties are the primary actors with responsibility for respecting, protecting, and fulfilling human rights for persons with disabilities. Political and legal systems need to organize and effectively enforce laws, policies and programs supporting human rights for persons with disabilities. Human rights "signify a moral code of conduct designed to promote human dignity, understanding, equality, fairness, and many other values and principles essential to just and peaceful societies." Human Rights Yes!, p. 10 </li>
<li><strong>Individuals:</strong> Individuals need to be educated so they can effectively realize their human rights. </li>
<li><strong>Civil Society Organizations:</strong> Organizations of Persons with Disabilities (OPDs), also called Disabled People's Organizations (DPOs), Non-Governmental Organizations (NGO), and human rights organizations all have a role to play in promoting and monitoring human rights conventions. </li>
<li><strong>The Private Sector:</strong> Private sector actors include employers large and small, providers of goods and services, entertainers, and construction entities. Interacting with the community of persons with disabilities provides a forum for observing, correcting, supporting and otherwise monitoring the enforcement of human rights. Business owners have a role to play in supporting States Parties' efforts to enforce human rights for persons with disabilities.</li>
</ul>
<p>Now that we have a grounding in the world of human rights, we can turn our attention to the core principles and concepts underlining disability law and rights.</p>

<h3>The UN Convention on the Rights of Persons with Disabilities</h3>
<p>Now let's shift to the CRPD process at the United Nations.</p>
<p>The Treaty was initiated in 2001 with a proposal by Mexico to the UN General Assembly.</p>
<p>Mexico had attended the World Conference against racism in Durban, South Africa that year, and they had introduced it into the final platform of that conference. Some language around disability and their interest in pushing forward a process that might result in the adoption of a convention on the Rights of Persons with Disabilities.</p>
<p>Mexico was very clever and innovative in using the platform they had at that Durban Conference against Racism to start lobbying for this effort. So, then they arrived in New York at the UN General Assembly and were successful and having a resolution adopted and also created an ad hoc committee within the General Assembly to consider proposals for drafting a convention on the rights of persons with Disabilities.</p>
<p>That committee was established, and it started its work in 2002 having 8 sessions of about 2 weeks each and one working group session</p>
<p>There was a working group session as well in 2004 that put together the first draft treaty which has formed the basis for the rest of the negotiations up until the adoption of the CRPD in 2006.</p>
<p>By the end of the process, over 800 individuals representing civil society, people with disabilities from all over the world were participating in the drafting of the Treaty.</p>
<p>It was an incredibly dynamic and participatory process and the voice of people with disabilities throughout the treaty negotiations fundamentally altered the substantive content of the CRPD and it's why we have the document we have today.</p>
<p>In 2006, the United Nations General Assembly adopted the Convention on the Rights of Persons with Disabilities (CRPD), the first international convention that addresses the human rights of persons with disabilities.</p>

<h3>The current status of the Treaty</h3>
<p>The Convention on the Rights of Persons with Disabilities and Optional Protocol entered into force on 3 May 2008, after the Convention received its 20th ratification, and the Optional Protocol 10 ratifications.</p>
<p>This marked a major milestone in the effort to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms of persons with disabilities, and to promote respect for their inherent dignity</p>
<p>In other words, it allows for some extra authority to consider individual or group complaints as to violations of the Treaty against a State party and also a procedure whereby the committee, the Treaty body, can undertake an investigation in the case of grave or systemic violations.</p>
<p>And fundamentally, what the CRPD does is shift the way in which disability has been framed in international law, policy and practice and it is most surely reflective of the social model understanding of disability.</p>

<p>"Nothing about us without us" was a mantra of the disability rights community, and persons with disabilities were involved in the drafting of the Treaty to an extent not repeated by other groups in a UN human rights treaty process. As a result, the CRPD provides comprehensive coverage of human rights for persons with disabilities. Not to be overlooked are the multiple relationships formed by key stakeholders – NGOs, DPOs, governments and the United Nations – in the caldron of negotiation and debate.</p>
<p>Now that the CRPD is international law, the challenge is to advocate governments around the world to ratify the CRPD and work to eliminate discrimination based on disability. The global disability community consists of you, me and every single human being with a disability, and that community is huge.</p>

<h3>Core concepts and the CRPD structure</h3>
<p>All human rights are indivisible, interdependent, and interrelated. What it means is that all of the articles of the CRPD are important and intertwined with each other.</p>
<p>All the Articles do not create new rights. What they do is provide States Parties with a road map for achieving full and equal inclusion of persons with disabilities in all matters of human life.</p>
<p>So, what are some of the key CRPD concepts?</p>
<ul>
<li>The CRPD expresses a social model orientation of disability that's reflected in the preamble.</li>
<li>Sets forth a comprehensive set of rights in a disability specific context, covering civil, political, economic, social and cultural rights</li>
<li>It provides that states are mandated to provide "reasonable accommodation." Thus, the duty to provide reasonable accommodation becomes an integral element of non-discrimination that is owed to an individual with a disability.</li>
<li>Accessibility is an obligation for broad-based measures to benefit persons with disabilities and other groups collectively.</li>
<li>And finally, disability is heterogeneous and reflects natural human variation - one of the principles in the Treaty is respect for difference.</li>

<h3>The CRPD structure</h3>
<p>The structure of the CRPD starts with the articles of general application:</p>
<h4>Article 1 - Purpose</h4>
<p><em>The purpose of the CRPD,</em> sets out the purpose of the Treaty: "promote, protect, and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity." Persons with disabilities are entitled to the same human rights as all other persons.</p>
<h4>Article 2 – Definitions</h4>
<p>Lists several definitions that are important to understand and remember:</p>
<p>"Communication" includes languages, display of text, Braille, tactile communication, large print, accessible multimedia as well as written, audio, plain-language, human-reader and augmentative and alternative modes, means and formats of communication, including accessible information and communication technology;</p>
<p>"Language" includes spoken and signed languages and other forms of non-spoken languages;</p>
<p>"Discrimination on the basis of disability" means any distinction, exclusion or restriction on the basis of disability which has the purpose or effect of impairing or nullifying the recognition, enjoyment or exercise, on an equal basis with others, of all human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field. It includes all forms of discrimination, including denial of reasonable accommodation;</p>
<p>"Reasonable accommodation" means necessary and appropriate modification and adjustments not imposing a disproportionate or undue burden, where needed in a particular case, to ensure to persons with disabilities the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedoms;</p>
<p>"Universal design" means the design of products, environments, programmes and services to be usable by all people, to the greatest extent possible, without the need for adaptation or specialized design. "Universal design" shall not exclude assistive devices for particular groups of persons with disabilities where this is needed.</p>
<p>The next following articles of general application impact on the rest of the CRPD.</p>
<p>Article 3 – General principles;</p>
<p>Article 4 – General obligations;</p>
<p>Article 5 – Equality and non-discrimination;</p>
<p>Article 6 – Women with disabilities;</p>
<p>Article 7 – Children with disabilities;</p>
<p>Article 8 – Awareness-raising; and,</p>
<p>Article 9 – Accessibility.</p>
<p><em>Let's analyze some of them in more detail.</em></p>
<h4>Article 3 - General principles</h4>
<p>This article provides eight guiding principles that underlie the Convention and each one of its specific articles. These eight principles provide the platform for the development of laws, polices, and practices that are pertinent to persons with disabilities.</p>
<p>Interpretation of the CRPD, including monitoring and implementation, must reference <em>Article 3</em>:</p>
<p><em>Select each tab to learn more.</em></p>
<ol>
<li><strong>Dignity, autonomy, and choice</strong>: the implementation of <em>Article 25 – Health</em>.<br /> Must reflect the principles of dignity, respect, choice of medical services, equality, and autonomy. Respect for inherent dignity, individual autonomy including the freedom to make one's own choices, and independence of persons;</li>
</ol><ol start="2">
<li><strong>Non-discrimination: </strong>the implementation of <em>Article 28 – Adequate standard of living</em>.<br /> Prohibits discrimination based on disability.</li>
</ol><ol start="3">
<li><strong>Participation and inclusion: </strong>the implementation of <em>Article 30 – Participation in cultural life</em>.<br /> Applicable when persons with disabilities participate in and are included in the cultural life of the community.</li>
</ol><ol start="4">
<li><strong>Respect for difference: </strong>the implementation of <em>Article 8 – Awareness-raising</em>. <br /> Emphasizes pride in and respect for difference which persons with disabilities work to educate society. Respect for difference and acceptance of persons with disabilities as part of human diversity and humanity;</li>
</ol><ol start="5">
<li><strong>Equality of opportunity: </strong>the implementation of <em>Article 27 – Work and employment</em>.<br /> Calls for measures to ensure equality of opportunity in the workplace.</li>
</ol><ol start="6">
<li><strong>Accessibility: </strong>the implementation of <em>Article 29 – Participation in political and public life</em><br /> Requires measures that ensure accessibility in voting booths for persons with disabilities.</li>
</ol><ol start="7">
<li><strong>Equality between men and women: </strong>the implementation of <em>Article 13 – Access to justice.</em><br /> Requires acknowledgment that women face barriers to justice that men do not.</li>
</ol><ol start="8">
<li><strong>Respect for the evolving capacities of children: </strong>the implementation of <em>Article 26 – Habilitation and rehabilitation.</em><br /> Will require opportunities for children with disabilities to have a say in their rehabilitation needs. disabilities and respect for the right of children with disabilities to preserve their identities.</li>
</ol>
<p>The CRPD is unique because it raises concepts implicit in other human rights treaties and makes them explicit. For example, accessibility, respect for difference, and inclusion undergird the drive for independent living for persons with disabilities in lieu of warehousing persons with disabilities in institutions that restrain and restrict their lives.</p>
<h4>Article 4 - General obligations</h4>
<p>Article 4 lays out a set of demands on States Parties "to ensure and promote the full realization of all human rights and fundamental freedoms for all persons with disabilities without discrimination of any kind on the basis of disability." To fulfill these obligations, States Parties will undertake:</p>
<ol>
<li>Pass legislation, administrative rules and other measures designed to implement the rights enshrined in the Convention;</li>
<li>Modify or abolish laws, regulations, customs and practices that discriminate against persons with disabilities;</li>
<li>Protect and promote human rights of persons with disabilities in policies and programmes;</li>
<li>Refrain from actions or practices that are inconsistent with the Convention, and ensure that public authorities and institutions act in conformity with the Convention;</li>
<li>Take appropriate measures to eliminate discrimination on the basis of disability by any person, organization or private enterprise;</li>
<li>Promote research and development of universally designed goods, services, equipment and facilities, including promoting universal design in the development of standards and guidelines;</li>
<li>Promote research and development of new technologies, including information and communication technologies, mobility aids, devices and assistive technologies for persons with disabilities;</li>
<li>Provide accessible information to persons with disabilities about mobility aids, devices and assistive technologies;</li>
<li>Promote the training of professionals.</li>
</ol>
<p>Article 4 mirrors other human rights treaties except that with respect to persons with disabilities, States Parties face certain requirements not included in the other human rights treaties. For example, States Parties must promote universal design for goods and services and undertake research on accessible technologies and assistive technologies.</p>
<p>Traditionally States Parties regarded its obligations toward persons with disabilities as optional or special treatment. The CRPD's general obligations article is designed to change that attitude and promote the understanding of these obligations as fundamental human rights obligations.</p>
<h4>Article 5 - Equality and non-discrimination</h4>
<p>Article 5 rounds off the above ideas with the recognition that all persons are created equal before the law and deserve the equal protection and benefit of the law. To be equal before the law requires the elimination of discrimination which in turn sometimes requires the provision of reasonable accommodations.</p>
<p>Equality and non-discrimination are cores of the Convention: the idea that States Parties "shall prohibit all discrimination on the basis of disability and guarantee to persons with disabilities equal and effective legal protection against discrimination on all grounds." Thus, for instance, provision for "reasonable accommodations" promotes equality and eliminates discrimination. Finally, specific measures designed to accelerate or achieve "de facto equality" shall not be considered discrimination under the Convention.</p>
<h4>Article 9 - Accessibility</h4>
<p>Accessibility, like non-discrimination, is a general principle reflected in Article 9. Its implementation measure is drafted very broadly.</p>
<p>It requires states to ensure that persons with disabilities access on an equal basis with others to the physical environment, transportation information and communications, including information and communications technologies and systems and two other facilities and services open or provided to the public in both urban and rural areas.</p>
<p>An important distinction between "reasonable accommodation" and "accessibility" measures is that reasonable accommodation is a right of an individual, while accessibility are provided as the collective right - an obligation that benefits the community as a whole.</p>
<h4>Articles 10 to 30</h4>
<p>Articles 10 to 30 address specific rights like access to justice, education, health care, employment, and political participation. Many of these articles are drawn from other human rights treaties.</p>
<p>Note the <em>Article 29 - Participation in political and public life, </em>which is also a principle and a core obligation and it's reflected throughout the Treaty and reminds us of the important role that persons with disabilities played in the drafting of the CRPD standing their ground day in day out to ensure that their voices were heard.</p>
<p>Just like Article 29 affirms the right of persons with disabilities to participate in political and public life, Article 33 affirms that persons with disabilities and their organizations have the right to participate in monitoring the CRPD at the National level.</p>

<p>The creation of the CRPD was unique in that people with disabilities were involved in drafting the Treaty to an extent not repeated by other groups in a U.N. human rights treaty process. As a result, the CRPD provides comprehensive coverage of human rights for persons with disabilities. Not to be overlooked are the multiple relationships formed by key stakeholders – NGOs, DPOs, governments and the United Nations – in the caldron of negotiation and debate.</p>
<p>All the Articles do not create new rights. What they do is provide States Parties with a road map on the way to the Holy Grail: achieving full and equal inclusion of persons with disabilities in all matters of human life.</p>
<p>Now that the CRPD is international law, the challenge is to advocate governments around the world to ratify the CRPD and work to eliminate discrimination based on disability. All human rights are indivisible, interdependent, and interrelated. Every Article of the CRPD is important and are intertwined.</p>
<p>Some questions you should consider when thinking about the CRPD:</p>
<ol>
<li>What is the purpose of the CRPD?</li>
<li>What are some of the general principles articulated in Article 3?</li>
<li>What are some of the general obligations in Article 4?</li>
<li>How is your country doing with equality and non-discrimination under Article 5?</li>
<li>Pick one Article between Articles 10 and 30 and explain how your country is doing with that Article, what are some of the strengths and weaknesses in your country's performance?</li>
<li>What is the role of the Disabled People's Organization in the CRPD, and where can it provide meaningful information on a government's performance?</li>
<li>What is the Optional Protocol, and how will it make a difference in enforcing the CRPD?</li>
</ol>
<p>As an advocate for human rights, you can use the CRPD as a tool for effectuating meaningful change in the lives of people with disabilities in your country. Good luck!</p>
